Visitation Lawyer in Dallas

Helping Families Manage Life After Divorce

For divorced parents, one major complication is their ability to spend time with their children. Excluding cases where there is a concern for the child’s safety, the courts generally rule for joint custody of a child, with one parent being assigned as the primary residence or custodial parent. The other parent, known as the noncustodial parent, will be granted visitation with the child.

  • Violation of visitation by a noncustodial parent

    Visitation Schedules

Parents who have gone through a divorce are required to make a schedule of child visitation and then submit it to the court. The court will only approve the schedule if they determine it to be in the best interest of the child.

Upon court approval, this visitation schedule is legally binding upon both parents and dictates when each parent has access to the child. If a schedule cannot be agreed upon between the parents, the court will order the standard visitation order.

The primary rules of the standard visitation order include:

    • The child visiting the noncustodial parent every 1st, 3rd, and 5th weekend from 6 p.m. on Friday to 6 p.m. on Sunday
    • The child visiting the noncustodial parent during the school year from 6 p.m. to 8 p.m.
    • The child beginning weekend visits on Thursday at 6 p.m. when there is a school holiday on Friday
    • The child concluding weekend visits on Monday at 6 p.m. when there is a school holiday on Monday
    • The child visiting the noncustodial parent on certain holidays during alternating years
    • The child visiting the noncustodial parent from July 1 to 31, with the custodial parent being granted one weekend during that time
